GENERAL TERMS AND CONDITIONS OF SALE AND USE

1. IDENTIFICATION OF THE OWNER AND SCOPE OF APPLICATION

These General Terms and Conditions of Sale and Use (hereinafter, the “Terms”) govern access to, browsing and purchasing products through the website

Hereinafter, the owner shall be referred to as “Miune”, “we”, “us” or the “Seller”. Any person who accesses the Website or makes a purchase shall be referred to as the “User” or the “Customer”. When acting for purposes unrelated to their business, trade, craft or profession, they shall also be considered a consumer or user.

Before making a purchase, the Customer must read these Terms, the Privacy Policy, Cookie Policy, Shipping Policy and Returns and Refunds Policy. By completing an order, the Customer confirms that they have been able to access this information and accept the conditions applicable to the purchase, without prejudice to any mandatory consumer rights granted by law.

2. SHOPIFY PLATFORM

The Website uses Shopify’s technological infrastructure to enable us to operate the online store. However, purchases made through the Website are entered into directly between the Customer and Miune. Miune is the seller responsible to the Customer for order management, delivery, after-sales support, the legal guarantee and, where applicable, withdrawal and refunds.

Shopify is not the seller of the products offered by Miune. Shopify’s processing of personal data shall be governed by the information provided in our Privacy Policy and by applicable law.

3. CAPACITY TO ENTER INTO A CONTRACT

To make a purchase, the Customer must be at least 18 years old or have sufficient legal capacity to enter into a contract under applicable law.

The Customer guarantees that the information provided during the purchasing process is truthful, complete and up to date. If purchasing on behalf of another person or entity, the Customer confirms that they have sufficient authorization to do so.

The Customer is responsible for maintaining the confidentiality of their account credentials, if an account is created, and must notify us without delay of any unauthorized use of which they become aware.

4. PRODUCT INFORMATION

Miune endeavors to display the essential characteristics of its products clearly and accurately, including, where applicable, their description, materials, dimensions, package contents, instructions for use, availability and price.

Product photographs and videos are provided for informational purposes. Minor differences in color or appearance may occur due to lighting, screen settings, manufacturing processes or digital representation, provided that such differences do not affect the advertised essential characteristics or constitute a lack of conformity.

Miune is bound by the descriptions, characteristics and commercial statements forming part of the offer at the time the order is placed. Nothing in these Terms limits the Customer’s right to receive a product that conforms to the contract.

The Customer must follow all instructions regarding assembly, use, care, cleaning and safety included with the product or published on its product page.

5. AVAILABILITY

All orders are subject to product availability. If, after accepting an order, a product is unavailable, we shall inform the Customer without undue delay and issue a full refund of all amounts paid for the unavailable product using the same payment method, unless the Customer expressly agrees to another solution.

The mere inclusion of a product on the Website does not mean that it will remain available indefinitely. Miune may withdraw products or limit quantities before a purchase is completed, provided that previously accepted orders and applicable law are respected.

6. PURCHASING PROCESS AND FORMATION OF THE CONTRACT

To make a purchase, the Customer must select the product and its variants, add it to the shopping cart, provide the requested information, review the order summary and click the button clearly indicating that the order entails an obligation to pay.

Before confirming the purchase, the Customer may identify and correct errors in the information entered. The Customer is responsible for carefully reviewing the product, model, variant, quantity and delivery address.

Once the order has been placed, Miune shall send confirmation by email or another durable medium. The contract shall be concluded when Miune communicates its acceptance of the order. The confirmation shall include, or allow the Customer to retain, the essential conditions of the purchase.

Miune may reject or cancel an order before shipment where justified grounds exist, including lack of availability, inability to verify payment, reasonable suspicion of fraud, an obvious pricing error that a reasonably diligent person could have recognized or a legal inability to supply the product. In such cases, the Customer shall be informed and all amounts charged shall be refunded without undue delay.

7. PRICES, TAXES AND ADDITIONAL CHARGES

Prices displayed to consumers include all legally applicable taxes, unless it is clearly stated that the Customer is acting as a business and a different tax regime applies.

Before the order is confirmed, the total price shall be displayed, including taxes, shipping costs and any other known additional charges. The Customer shall not be required to pay any costs that were not clearly disclosed before completing the purchase.

Where a shipment may incur import duties, tariffs or customs charges not included in the price, this circumstance and, where possible, the method used to calculate them shall be communicated before purchase.

Promotions shall be subject to their specific conditions, validity period and availability. In the event of a conflict, the condition most favorable to the consumer shall apply, except in cases of obvious error or where otherwise required by law.

8. PAYMENT METHODS

The Customer may pay using the methods displayed during the purchasing process: CARD, PAYPAL, SHOP PAY, KLARNA OR OTHER METHODS ACTUALLY AVAILABLE.

Payments shall be processed through secure third-party providers. Miune does not directly store complete card details when payment is managed by these providers.

The Customer confirms that they are authorized to use the selected payment method. If payment is declined or cannot be verified, the order may not be accepted.

9. PROCESSING, SHIPPING AND DELIVERY

Delivery areas, shipping methods, costs and estimated time frames shall be stated in the Shipping Policy and during the purchasing process.

  • Standard processing time: 1 TO 3 BUSINESS DAYS.

  • Estimated delivery time in Spain/EU: 7 TO 15 BUSINESS DAYS.

  • Estimated international delivery time: 15 TO 25 BUSINESS DAYS.

The communicated time frames are estimates unless a guaranteed delivery date is expressly stated. In all cases, unless otherwise agreed with the Customer, the order shall be delivered without undue delay and no later than 30 calendar days after the contract is concluded.

If a delay occurs, Miune shall inform the Customer as soon as reasonably possible. Where legally applicable, the Customer may grant an appropriate additional period for delivery. If delivery is not completed within that additional period, the Customer may terminate the contract and receive the corresponding refund. No additional period shall be required where delivery on a specific date is essential and this was communicated and agreed before purchase, or where Miune refuses to deliver the order.

The risk of loss of or damage to the product shall pass to the consumer when the consumer, or a third party designated by them other than the carrier, takes physical possession of the order. As an exception, if the consumer independently appoints a carrier not proposed by Miune, the risk shall pass when the product is delivered to that carrier.

The Customer must provide an accurate and accessible delivery address. If delivery cannot be completed because of incorrect or incomplete information attributable to the Customer, we may request payment of the reasonable costs actually incurred for a new shipment, provided that the Customer is informed in advance.

10. RECEIPT OF THE ORDER AND SHIPPING ISSUES

The Customer should inspect the external condition of the package upon receipt and report any visible damage, incorrect product, missing items or other issue as soon as possible, preferably within 48 hours, attaching photographs where useful.

This notification period facilitates our communication with the carrier but does not remove or reduce the consumer’s statutory rights or legal guarantee relating to a lack of conformity.

To report an issue, the Customer must email infoequipoelue@use.startmail.com, stating the order number and describing the problem.

11. RIGHT OF WITHDRAWAL

Where the Customer is a consumer and no statutory exception applies, they may withdraw from the purchase without providing a reason within 14 calendar days from the day on which the Customer, or an authorized third party other than the carrier, receives the product.

To exercise the right of withdrawal, the Customer must communicate their decision by means of an unequivocal statement sent to:

The Customer may use the withdrawal form provided by Miune, although its use is not mandatory. It is sufficient for the communication to be sent before the withdrawal period expires.

The Customer must return the products without undue delay and no later than 14 calendar days after communicating their decision to withdraw, using the return instructions and operational return address provided by Miune.

The Customer shall bear the direct cost of returning the product following withdrawal unless Miune has expressly agreed to bear that cost or failed to inform the Customer of this obligation in advance.

Miune shall refund the payments received for the returned products and, where applicable, the standard delivery costs. Any additional cost resulting from the Customer voluntarily selecting a more expensive delivery method than the standard option offered shall not be refunded.

The refund shall be issued within 14 calendar days of the withdrawal notification and using the same payment method, unless expressly agreed otherwise. Miune may withhold the refund until the products have been received or until the Customer provides proof of return, whichever occurs first.

The Customer may examine the product in the same way as they would in a physical store. The Customer shall only be responsible for any reduction in value resulting from handling beyond what is necessary to establish the product’s nature, characteristics and functionality.

12. DEFECTIVE OR NON-CONFORMING PRODUCTS AND LEGAL GUARANTEE

Miune is liable to the consumer for any lack of conformity existing at the time of delivery that becomes apparent within the applicable statutory period. For new goods sold in Spain, this period is three years from delivery, without prejudice to the applicable rules regarding presumptions and other statutory provisions.

A lack of conformity exists, among other circumstances, where the product does not match its description, does not possess the quality or performance reasonably expected, is not suitable for its advertised ordinary use, does not include the promised accessories or instructions, or has a manufacturing defect.

In the event of a lack of conformity, the consumer may request repair or replacement unless either option is impossible or disproportionate. Where permitted by law, the consumer may request a price reduction or termination of the contract.

Any measures necessary to bring the product into conformity shall be free of charge for the consumer, including necessary shipping or transportation costs, and shall be completed within a reasonable time and without significant inconvenience.

To make a warranty claim, the Customer must contact infoequipoelue@use.startmail.com, providing the order number, a description of the issue and, where reasonable, photographs or videos allowing the issue to be assessed. The absence of the original packaging does not, by itself, invalidate the legal guarantee.

The guarantee does not cover damage caused exclusively by use contrary to the instructions, accidents occurring after delivery, modifications made by the Customer, normal wear and tear, or clearly improper washing or care, provided that such circumstances caused the damage and no original lack of conformity existed.

13. ORDER CANCELLATION

The Customer may request cancellation by emailing infoequipoelue@use.startmail.com. If the order has not yet been prepared or shipped, we shall attempt to cancel it and refund the amounts paid.

If the order has already been shipped and cannot be stopped, the consumer shall retain their right of withdrawal under the terms stated above. This section does not limit the Customer’s statutory rights.

14. CUSTOMER SERVICE AND COMPLAINTS

The Customer may submit questions, report issues or make complaints through:

We shall respond to complaints as quickly as possible and, in all cases, within the applicable statutory period.

Miune provides official complaint forms to consumers where required by applicable regional regulations.

15. FORCE MAJEURE

Neither party shall be liable for a failure to perform caused exclusively by unforeseeable or unavoidable events beyond its reasonable control, including natural disasters, conflicts, general strikes, official closures, public health emergencies or serious infrastructure disruptions.

Miune shall inform the Customer when such circumstances materially affect their order and shall take reasonable measures to reduce their impact. This clause does not limit any mandatory consumer rights, including the right to terminate the contract and recover amounts paid where legally applicable.

16. LAWFUL USE OF THE WEBSITE

The User agrees to use the Website lawfully and not to:

  • Engage in fraudulent activities or impersonate others.

  • Introduce viruses or malicious code or attempt to compromise the Website’s security.

  • Access accounts, systems or data without authorization.

  • Extract or reuse content on a large scale through automated means where doing so infringes the law or our rights.

  • Use the Website to infringe intellectual property rights, privacy rights or other third-party rights.

  • Submit unlawful, threatening, discriminatory, defamatory or offensive content.

Miune may restrict or suspend access where there are reasonable indications of fraud, security risks or a serious breach of these Terms. Any measure taken shall be proportionate and shall not affect rights arising from validly concluded orders.

17. INTELLECTUAL AND INDUSTRIAL PROPERTY

Unless otherwise stated, the text, designs, photographs, videos, logos, trademarks, graphics and other content created or licensed for the Website belong to Miune or their lawful owners and are protected by applicable law.

Access to the Website does not grant the User any exploitation rights over this content. It may not be reproduced, distributed, modified or used commercially without authorization, except where permitted by law.

Third-party trademarks and content belong to their respective owners. Nothing in these Terms implies that Miune owns rights that legally belong to third parties.

18. REVIEWS, COMMENTS AND CUSTOMER CONTENT

When the Customer voluntarily submits a review, photograph, video or comment for publication, they confirm that they possess the necessary rights and that the content does not infringe third-party rights or contain unlawful information.

The Customer grants Miune a non-exclusive, royalty-free license, limited to the time necessary, to reproduce, adapt for formatting purposes, publish and communicate that content on the Website and through Miune’s commercial channels.

Miune may moderate or remove content that is unlawful, false, offensive or infringes third-party rights. Reviews shall not be removed solely because they express a legitimate negative opinion.

Where a review has been incentivized, this circumstance must be clearly disclosed. Miune shall not publish false reviews or present content that does not originate from genuine customers or users as real customer experiences.

19. THIRD-PARTY LINKS AND SERVICES

The Website may contain links to or integrate third-party services, including payment platforms, carriers and social media platforms. These third parties may apply their own terms and privacy policies.

Miune does not control the content of external websites. However, this clause does not exclude any liability that Miune may legally have in relation to the purchase, payment, delivery or any ancillary service integrated into the transaction.

20. DATA PROTECTION AND COOKIES

The processing of personal data is governed by our Privacy Policy. The use of cookies and similar technologies is governed by the Cookie Policy available in the website’s policy section.

The Customer should review both policies before using the Website or making a purchase. Marketing communications shall only be sent where a valid legal basis exists, and recipients may unsubscribe at any time.

21. LIABILITY

Miune shall be responsible for fulfilling its obligations as the Seller and does not exclude or limit its liability where such exclusion or limitation is prohibited by law.

Miune shall not be liable for damages caused exclusively by use contrary to the instructions, unlawful actions by the User, incorrect information provided by the User or external services unrelated to the purchase and beyond its control, provided that Miune has acted with the diligence required by law.

Nothing in these Terms limits liability for defective products, personal injury, willful misconduct, gross negligence, lack of conformity, breach of contract attributable to Miune or any other mandatory consumer right.

22. SEVERABILITY

If any provision of these Terms is declared invalid, unlawful or unenforceable, it shall be deemed removed to the relevant extent. The remaining provisions shall continue to apply provided that the contract can remain in force without the affected clause.

23. AMENDMENTS TO THE TERMS

Miune may update these Terms to reflect legal, technical or commercial changes. The version applicable to each purchase shall be the version published and accepted when the order was placed.

Subsequent amendments shall not alter contracts already entered into unless required by law or expressly accepted by the Customer where necessary.

24. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by Spanish law, without depriving consumers of the protection afforded by the mandatory laws of their country of residence where applicable.

In the event of a dispute, the parties may first attempt to reach an amicable solution through the customer service channels. If no agreement is reached, jurisdiction shall lie with the courts and tribunals determined by applicable law. Where the Customer is a consumer, they shall not be required to submit to courts other than those legally competent to hear the dispute.
